Terms of Service

By creating a SyncedUp account or using the ClosetSync iOS app, you agree to these Terms of Service ("Terms"). If you do not agree, do not use SyncedUp.

1. Who can use SyncedUp

ClosetSync is available to anyone 17 years of age or older. The app is rated 17+ because it uses AI-generated imagery and user-uploaded photos, and AI content can occasionally produce unintended results.

2. Your content

You retain all rights to the photos, items, and outfits you upload. You grant us a limited, non-exclusive, non-transferable license to process your content solely to provide the service (AI cleanup, metadata extraction, outfit suggestion, on-model try-on). We do not use your content to train AI models. Our third-party processors commit to the same by contract.

You are responsible for what you upload. Do not upload:

• photos of other people without their consent
• photos depicting minors in any way
• nudity, sexually explicit content, or content promoting violence, hate, or harassment
• copyrighted material you do not own or have permission to use
• content intended to deceive or defraud (e.g., deepfakes)

3. AI-generated output

ClosetSync uses third-party AI models (OpenAI, Anthropic, Google Gemini). AI output is probabilistic. We make no guarantees about accuracy, fitness for a particular purpose, or that a try-on composite will be photorealistic. You accept AI output at your own discretion. Do not rely on AI suggestions for safety-critical decisions.

4. Acceptable use

• No reverse engineering, scraping, or automated abuse of the service.
• No sharing your account with others.
• No attempts to bypass rate limits or safety filters.
• No uploading of content you know or should know is illegal.

We may suspend or terminate accounts that violate these rules, with or without notice.

5. Fees

ClosetSync v1 is free. If we introduce paid tiers, you will be notified in-app before any charge. Fees purchased via Apple In-App Purchase are governed by Apple’s terms; refund requests for IAP must go through Apple.

6. Closet Circle — friend sharing and borrowing

ClosetSync’s Closet Circle feature lets you invite friends, selectively share items and outfits, request to borrow clothing, and leave short feedback on a friend’s outfit. By using these features you agree:

• Visibility is your choice. Every closet item defaults to private. You choose to make an item “circle view” (friends can see it) or “borrowable” (friends can see it and request to borrow it). You can change any item back to private at any time — doing so cancels any pending borrow requests on it.
• You are responsible for the physical items you lend. ClosetSync facilitates the request/approve workflow, the calendar dates, and the audit log. It is not a party to the physical exchange, does not arbitrate damage or loss, and does not hold deposits. Borrow at your own discretion.
• Feedback and comments must be respectful. Do not use SyncedUp’s comment, vote, or report features to harass, defame, or threaten other users. Content that violates this or our overall Acceptable Use policy will be removed and the account may be suspended.
• Report + block are always available. Every outfit comment, shared item, and friend shows a report affordance. You can block any user from your account settings, which removes the friendship, cancels any pending borrow requests between you, and prevents the user from seeing your content or contacting you.
• We act on good-faith reports. Our trust-and-safety team will acknowledge reports within 24 hours and act on them within 72 hours. Actioned reports may result in content removal, account suspension, or — for legal violations — permanent termination.
• Account deletion cascades. When you delete your account, your friendships, invites you sent, shared outfit records, and pending borrow requests are removed. Comments you left on friends’ outfits are anonymised (not deleted) so the thread context remains for the friend.

6a. Public profiles + public content

You can choose to make your profile public, in which case anyone — including logged-out visitors — can see your username, optional display name, optional bio, and any items or outfits you have specifically marked “Public.” Public is opt-in per item and per outfit; nothing becomes public unless you explicitly toggle it. You can switch your profile or any item back to private at any time. By making content public you agree:

• Items you mark public are surfaced on your public profile and may appear in browse / discovery surfaces if we add them in a future release.
• Public images are served via short-lived signed URLs (1-hour TTL) so links cannot be permanently shared. We do not guarantee that no one will copy a public image.
• Your model/body-reference photo remains private unless you turn on the “show my avatar publicly” toggle.
• All public uploads pass through automated content moderation before they appear publicly. Content flagged or rejected is held for human review or refused outright.
• Other users can report your public content; we will review reports per our trust-and-safety process.

6b. Trades and swaps

You can request to swap an item with another user (no money changes hands in v1). Trades are arranged between you and the other user; ClosetSync facilitates the request flow but is not a party to the physical exchange and does not arbitrate disputes. Use trades at your own discretion. Both sides can cancel any time before completion. Reporting a trade as “issue” flags it for our trust-and-safety team.

6c. Marketplace (coming later)

A future release of ClosetSync may introduce a marketplace where users can list items for sale. That release will include separate disclosures, seller obligations, dispute terms, and payment processor information (Stripe). The current version of these Terms does NOT cover marketplace transactions; do not attempt to use SyncedUp to buy or sell physical goods until that release ships and you accept its updated Terms.

6d. Product links & commissions

SyncedUp displays product suggestions from third-party retailers, including the Amazon Associates Program. Tapping a product link may navigate you outside the app to a retailer's website. SyncedUp may earn a commission on qualifying purchases at no additional cost to you. You are responsible for any transactions you complete with the retailer; SyncedUp is not a party to those transactions and does not warrant retailer pricing, inventory, or fulfillment.

7. Account deletion

You can delete your account at any time from within the app (Account → Delete) or via POST /api/closetsync/account/delete. Deletion permanently removes your uploaded photos, generated composites, outfits, and profile. A timestamped audit row with a one-way hash of your email is retained for up to seven years for legal purposes.

8. Warranty disclaimer

ClosetSync is provided "as is" and "as available". To the maximum extent permitted by law, SyncedUp Solutions disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, SyncedUp Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of ClosetSync. Our total liability for any claim will not exceed the greater of $100 USD or the amount you paid to us in the 12 months preceding the claim.

10. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of laws. Any dispute will be resolved in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction there.
